Tip Story and Member may be referred to individually as "Party" and collectively as the "Parties."
DEFINITIONS
“Website” means that the website that consists of the domain name www.tipstory.io and sub-domains connected to this domain name, which can be accessed from the online environment, where various services and content are offered within the framework determined by Tip Story.
“Member” means any natural and legal person who wishes to benefit from Tip Story to purchase products, works, goods and services, by filling out the membership form they have chosen completely, and their membership is approved by Tip Story. Individuals over the age of 18 can become a member by completely filling out the relevant membership form on the Website with their real identity information. “Member name” is unique to the member and the same “Member name” cannot be given to two different Members.
“User” means the person who visits the site with or without shopping.
“Content” means all kinds of information, files, pictures, programs, figures, prices, etc. published or accessible on the Website and/or any web site. visual, literary and auditory images.
“Personal Data” means in accordance with Article 3/d of the Law No. 6698 on the Protection of Personal Data (KVKK), all kinds of information regarding an identified or identifiable natural person and special quality personal data listed in Article 6/1 of the KVKK.
“Services” means the practices put forward by Tip Story in order to enable the Members to perform the work and transactions defined in this Membership Agreement.
SUBJECT AND SCOPE OF THE AGREEMENT
The subject of this Membership Agreement is the determination of the Services offered on the Website, the terms of benefiting from these Services and the rights and obligations of the parties. All statements such as warnings, notifications, applications and explanations made by Tip Story regarding the usage, membership and Services within the Website are within the scope of the Membership Agreement. By accepting the terms of this Membership Agreement, the User accepts and undertakes to comply with all kinds of statements made by Tip Story regarding the usage, membership and services in the Website.
MEMBERSHIP CONDITIONS
The User who wants to become a Member via registration must approve this Membership Form, fill in the information requested here with correct and up-to-date information, and the Membership application must be evaluated and approved by Tip Story. The user who wishes to become a member must be over 18 (eighteen) years old. Membership status begins with the entering the verification code sent to the e-mail address, and thus the Member attains the rights and obligations specified in this Membership Agreement. The Member, who does not provide accurate and up-to-date information while filling out the said Membership Form, is personally responsible for all damages that may arise due to this.
Tip Story, at any time without justification, without notice, compensation, penalty, etc. may unilaterally terminate this Membership Agreement, terminate or temporarily suspend the Member's membership, with immediate effect without any other obligation. Cases of violation of the rules specified on the Website, cases where the Member poses a risk to Tip Story's information security system, are cases of termination of membership or temporary suspension of membership.
RIGHTS AND OBLIGATIONS OF THE PARTIES
The Member accepts, declares and undertakes that he/she understands and approves the provisions of this “Membership Agreement” and all terms and rules on the Website. While benefiting from the services specified on the Website, the Member shall act in accordance with the laws of the Republic of Turkey and general moral rules, shall not engage in insults, threats, slander, harassment and similar acts, shall not engage in political or ideological propaganda, engage in offensive behaviour against other Members or Users, and shall not defame persons or institutions. The Member agrees and undertakes that he will stay away from all kinds of behaviour and refrain from any action that may cause the disruption or interruption of the services provided on the Website, otherwise he will be personally responsible for any damages that may occur.
In cases where Tip Story is obliged to make a statement to official authorities in accordance with the provisions of the current legislation; It accepts and undertakes that it is authorized to disclose confidential/private/personal data-private personal data/commercial information belonging to the Member to the official authorities, and therefore, it will not demand compensation from Tip Story under any name.
It is the Members' own responsibility to ensure the security of the 'username' and 'password' they use to access their Membership account on the Website; they must use it exclusively and individually, and hide it from third parties. The Member is responsible for any material and/or moral damages incurred or to be incurred by other Members and/or Tip Story and/or third parties due to their negligence or faults in this regard.
The Member shall not transfer this Membership Agreement or its rights and obligations under this Membership Agreement to any third party, in whole or in part, without the written approval of Tip Story.
The owner of this Website is Tip Story. Information, texts, pictures, brands, slogans, and other signs on this Website, as well as programs for the protection of information on other industrial and intellectual property rights, page layout, and presentation, database, website, HTML code of software codes and other codes, etc. related to the information on this Website or the Website pages by Tip Story or the organizations that Tip Story has permission and license for, is in its possession. The member shall not use someone else's credit card in any way. In case of any damage due to any violation of this matter, the Member assumes that all responsibility belongs to him, that he will not make any claim from Tip Story in case of using a credit card belonging to someone else, and in case Tip Story incurs a loss, Member’s responsibility. The Member irrevocably accepts, declares and undertakes that he shall be liable to cover all direct and/or indirect damages incurred.

CANCELLATION OF THE MEMBERSHIP AND TERMINATION OF THE AGREEMENT
In case the Member acts partially or completely against any or all of its obligations arising from this Membership Agreement, Tip Story may unilaterally terminate this Agreement without any notification and without justification, cancel the Member's membership and may partially or completely freeze or cancel the services that it has or will receive. Therefore, in the event of termination, the Member shall not claim any rights or claims from Tip Story. The member cannot object to this issue.
PRIVACY AND PERSONAL DATA
Tip Story may use the information transmitted to him by the Users and Members through the Website in accordance with the provisions of the 'Clarification Text on Membership' on the Website. It can process this information, classify and store it on a database. Tip Story also; User and Member's identity, address, e-mail address, telephone number, IP address, which parts of the Website he visits, domain type, browser type, visit date, time, etc. may also use the information for purposes such as statistical evaluation, announcement of campaigns and providing personalized services. Personal information of Users and Members will not be disclosed to real and legal third parties, except for the request of the authorities authorized by law and the cases listed in the 'Clarification Text on Membership'.
In case the Member is a natural person residing in the European Union, the Law No. 6698 on the Protection of Personal Data and its secondary regulations, as well as the decisions and regulations of the Personal Data Protection Board, will be applied regarding his personal data, and Turkish domestic law will be applied in all legal problems that may arise, regardless of the conflict of laws rules, 95 It accepts, declares and undertakes that the European Union Directive numbered /46/EC and the General Data Protection Regulation (GDPR) will not be implemented, and that the Turkish International Private Law and Procedural Law has waived the application of the conflict of laws rules.
FORCE MAJEURE
In all cases deemed force majeure by law, Tip Story is not liable for late or incomplete performance or non-performance of any of its actions determined by this Membership Agreement. This and similar situations will not be deemed as delay, incomplete performance or non-performance or default for Tip Story, or no compensation can be claimed from Tip Story under any name for these situations. The term force majeure; including but not limited to natural disasters, riots, wars, strikes, communication problems, infrastructure and internet failures, system improvement or renewal works and malfunctions that may occur due to this, power outages and bad weather conditions, and beyond the reasonable control of the relevant party; and it will be interpreted as unavoidable events that Tip Story could not prevent despite her due diligence.
APPLICABLE LAW AND AUTHORITY
In case there is an element of foreignness in the implementation and interpretation of this Membership Agreement and in the management of the legal relations arising within the scope of this Membership Agreement, Turkish Law shall be applied directly, excluding the Turkish conflict of laws rules. İzmir Central Courts and Execution Offices are authorized in the settlement of any disputes that arise or may arise due to this Membership Agreement.
VALIDITY OF TIP STORY RECORDS
The Member declares that the electronic and system records, commercial records, ledger records, microfilm, microfiche and computer records that Tip Story keeps in its own database and servers will constitute reliable, binding, definitive and exclusive evidence in case of disputes that may arise from this Membership Agreement, accepts, declares and undertakes that this article is in the nature of an evidential contract within the meaning of Article 193 of the Code of Civil Procedure.
NOTIFICATION
The Parties accept and undertake that the addresses specified during the membership process are legal notification addresses, and unless the other party is notified in writing of the address change, notifications to these addresses will have all legal consequences of the legally valid notification.
Member, changes to be made in the contract and services, cancellation of membership, termination of this Membership Agreement, termination etc. has agreed to make all kinds of notifications to the e-mail address specified during the membership process, and accepts, declares and undertakes that whether the notifications made by e-mail are received or not, the notification has been notified by Tip Story from the moment it is sent and it will have legal consequences. Tip Story is not responsible for the late or non-delivery of the notification to the member and its results
EFFECTIVENESS
The invalidity, illegality or inapplicability of any provision of the Membership Agreement shall not affect the validity of the remaining provisions of the Agreement.
This Membership Agreement, which consists of a total of 12 (twelve) articles, and the rules and conditions on the Website, entered into force by being concluded electronically with the electronic approval of the Member.
